Introduction
These Terms of Service ("Terms") govern your access to and use of Hayaa, a mobile application ("App") operated by Hayaa LLC, a Michigan limited liability company ("Hayaa", "we", "us", or "our").
By creating an account, installing the App, or otherwise using Hayaa, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
These Terms form a binding legal agreement between you and Hayaa LLC. Please read them carefully.
Eligibility
You must be at least 18 years old to create an account and use Hayaa. The App addresses sensitive topics (compulsive pornography and masturbation, recovery, mental health, and Islamic religious practice) that we believe are not appropriate to offer to minors.
By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms in your jurisdiction.
If we learn that an account belongs to someone under 18, we will close the account and delete the associated personal information.
Your Account
To use most features of the App, you must create an account. You may sign up with an email address and password or, where available, with Sign in with Apple or Sign in with Google.
You are responsible for safeguarding your account credentials and for any activity that occurs under your account. Notify us immediately at support@hayaa.io if you suspect unauthorised access.
You agree to provide accurate information during onboarding (including your age, sect, and other profile fields) and to keep it up to date. Providing materially false information may result in account termination.
You may have only one personal account. Creating duplicate accounts to evade bans, abuse referral programs, or work around any feature limit is prohibited.
Acceptable Use
You agree to use the App only for its intended purpose (your own personal recovery and reflection) and in accordance with our Community Guidelines.
You will not do any of the following.
- Harass, threaten, intimidate, or discriminate against other users, partners, or moderators.
- Post or share graphic descriptions of pornography, masturbation, sexual abuse, or self-harm in any community area or partner conversation.
- Glorify, encourage, or solicit relapse in others.
- Proselytise, denigrate other Islamic sects, or attempt to convert other users to a particular madhab. Hayaa serves Muslims of all backgrounds.
- Send unsolicited messages, advertise products or services, or recruit users for any commercial purpose.
- Impersonate any person, falsely state your affiliation with anyone, or use someone else's display name.
- Upload viruses, malware, or any code designed to disrupt the App or the devices of other users.
- Attempt to reverse-engineer, decompile, scrape, automate, or otherwise interfere with the App or our servers, except as permitted by applicable law.
- Use the App in violation of any applicable law or regulation.
The App provides educational and supportive content. It is not a substitute for professional medical, psychological, or religious counsel. If you are in crisis or considering self-harm, please contact local emergency services or a qualified professional. In the US you can call or text 988. Elsewhere, findahelpline.com lists local lines.
Your Content
You retain all rights in the content you create within the App, meaning journal entries, AI conversation messages, community posts and replies, partner messages, and any other material you author ("Your Content").
By submitting Your Content to the App, you grant Hayaa LLC a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, transmit, display, and adapt Your Content solely to operate and improve the App and to provide it to you and, where applicable, to other users you have authorised to see it (e.g. community posts visible to other community members of the same gender, partner messages visible to your matched partner).
This licence terminates when you delete the content or your account, except to the extent that we must retain copies for the purposes described in the Privacy Policy (legal compliance, fraud prevention, dispute resolution).
You represent and warrant that you have all rights necessary to grant this licence and that Your Content does not infringe the rights of any third party.
We may remove or restrict access to Your Content at our discretion if we believe it violates these Terms, the Community Guidelines, or applicable law.
Community Guidelines
Use of the community features (posts, replies, reactions, partner connections) is subject to the Hayaa Community Guidelines, available in Settings → Privacy and data → Community guidelines and incorporated into these Terms by reference.
Hayaa has zero tolerance for objectionable content and abusive users. We filter posts and messages automatically, review every report, remove content that breaks the rules, and suspend the accounts of users who post it.
Violations of the Community Guidelines may result in content removal or suspension of your whole account, depending on severity and recurrence.
Accountability Partners
Accountability partners are a Premium feature. When you link a partner, they see only the limited activity listed in our Privacy Policy and on the partner consent screen. They never see your journal, your Rafiq or Rafiqa conversations, or your messages to anyone else.
If you turn on Blocker alerts on Android, your partner is told when your Blocker is turned off or loosened, and whether it is on right now. These alerts stay on while you are partnered and have Premium. They end when the partnership ends, your Premium ends, you sign out on that phone, or you delete your account, and your partner is told about a sign-out.
Partner chat is private between the two of you. Be kind to your partner and follow the Community Guidelines in every message. If a partner makes you uncomfortable, you can report or block them from the chat, which ends the partnership.
Rafiq and Rafiqa
Rafiq and Rafiqa are AI companions powered by Claude, a model made by Anthropic. Their replies are written by a computer, can be wrong, and are not medical advice, therapy, or a religious ruling.
Verses and hadith they quote come from our verified library, but the explanation around them is the AI's own. Free and Premium accounts have daily message limits, which we may change. Do not use Rafiq or Rafiqa in an emergency.
The Blocker
The Blocker is a tool you set up for yourself. On Android it uses an Accessibility Service, and on iPhone it uses Apple's Screen Time. It helps you keep away from content you choose to block, but no blocker is perfect. It can miss content, be turned off through your phone's settings, or stop working after a system update. Do not rely on it as your only safeguard.
Locks, passcodes, and timers you set are designed to be hard to undo. Hayaa support cannot unlock them for you. If you forget a passcode or regret a lock, the only ways past it are waiting for the timer or the emergency unlock described below.
Emergency unlock. The Blocker lets you pay a one-time amount you chose in advance to open a lock straight away. We call it a tip because the money goes to Hayaa, but it is a purchase, not a donation or charity. It is charged once by the App Store or Google Play, does not renew, and opens the lock only as described on screen. While a lock is on, you can raise the amount but not lower it.
Subscriptions, Billing & Free Trials
Some features of the App require a paid plan ("Premium"), sold as a subscription or as a one-time Lifetime purchase. Both are sold through the Apple App Store and Google Play Store. Hayaa LLC does not process payments directly and does not receive or store your payment card or banking details.
All purchase, renewal, refund, and cancellation operations are governed by the terms of the store from which you purchased. See the Apple Media Services Terms and Conditions or the Google Play Terms of Service.
New users may be eligible for a free trial period. Trial length, eligibility, and behaviour are managed by RevenueCat and the underlying store. Unless cancelled before the end of the trial, your subscription automatically converts to a paid subscription at the price listed in the App when you started the trial.
Cancellation. You can cancel your subscription at any time through the subscription management screens of the Apple App Store or Google Play. We do not have the ability to cancel a subscription on your behalf. Cancellation takes effect at the end of the current billing period, and you retain Premium access until then.
Refunds. Apple decides refunds for App Store purchases. For Google Play purchases, you can ask Google, or email us and we may refund you through Google Play. Nothing in these Terms limits any right to cancel or get a refund that the law or the store gives you.
Lifetime. Hayaa Plus Lifetime is a one-time purchase that gives Premium on your account for as long as we offer the App, with no renewals. It does not cancel a subscription you already have, so cancel that in your store if you no longer want it. A refund of the Lifetime purchase ends the Premium it gave. The daily limits that apply to Premium, such as the Rafiq and Rafiqa message limits, apply to Lifetime too and may change as they do for every Premium account.
Other one-time purchases. Some optional features, such as the Blocker's emergency unlock, are one-time in-app purchases sold through the same stores. These are used when they are made, are not subscriptions, do not renew, and follow the same store purchase and refund terms described above. Each gives only the in-App effect described at the point of purchase.
Price changes. We may adjust prices for new purchases at any time. Existing subscribers will be notified of changes affecting their next renewal as required by the relevant App Store.
Suspension & Termination
You may stop using the App at any time and delete your account in-app under Settings → Privacy and data → Delete account.
We may suspend or terminate your access to the App, with or without notice, if we reasonably believe that (a) you have violated these Terms or the Community Guidelines, (b) your conduct poses a risk of harm to other users or to Hayaa, (c) we are required to do so by law, or (d) we are discontinuing the App or a feature you rely on.
If we suspend or close your account, you lose access to the whole App, including Premium, and you are signed out. Your store subscription is not cancelled automatically, so please cancel it in your App Store or Google Play settings. If we close your account for a reason that is not your fault, or where the law requires it, we will refund the unused part of your subscription where the store lets us.
Our App and Content
We give you a personal, non-transferable licence to use the App for your own recovery. Hayaa LLC and its licensors own the App and its content, including translations we license from others.
If you send us ideas or feedback, we may use them without paying you.
Copyright Notices
If you believe content in the App infringes your copyright, email support@hayaa.io with the subject line "Copyright Notice" and include the details listed in 17 U.S.C. 512(c)(3). We will review the notice and remove infringing content.
Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Hayaa does not warrant that the App will be uninterrupted, error-free, secure, or free of viruses. Hayaa also does not warrant that defects will be corrected, or that any specific feature will continue to be available.
Hayaa is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. Hayaa is not a medical, psychological, psychiatric, or religious authority. Content in the App (including AI-generated responses, Islamic content drawn from third-party sources, recovery suggestions, and milestone celebrations) is educational and supportive in nature. It is not a substitute for diagnosis, treatment, or scholarly religious guidance.
Verses, hadith, duʿās, and scholar references displayed in the App are drawn from public sources and may contain transmission errors or translation choices we do not endorse. Where you intend to rely on a citation for religious practice, consult a qualified scholar.
If you experience suicidal thoughts, self-harm urges, or any mental-health crisis, please contact local emergency services or a qualified professional immediately. The App is not designed to handle crisis situations.
Limitation of Liability
To the maximum extent permitted by applicable law, Hayaa LLC and its officers, directors, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including loss of profits, loss of data, loss of goodwill, or substitute service costs) arising from or relating to your use of the App, even if we have been advised of the possibility of such damages.
In no event will Hayaa LLC's aggregate liability arising from or relating to the App or these Terms exceed the greater of (a) one hundred US dollars (USD $100) or (b) the total amount you paid to Hayaa for the App in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the foregoing limitations apply to the maximum extent permitted by law.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that the law does not allow us to limit.
Indemnification
You agree to defend, indemnify, and hold harmless Hayaa LLC and its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with (a) your access to or use of the App, (b) Your Content, (c) your violation of these Terms or the Community Guidelines, or (d) your violation of any rights of a third party.
Disputes & Governing Law
These Terms are governed by the laws of the State of Michigan, United States of America, without regard to its conflict-of-laws principles.
Before initiating any formal legal action, you agree to first contact us at support@hayaa.io and attempt to resolve the dispute informally. We will attempt to respond and discuss within thirty (30) days. Many disputes can be resolved this way.
If informal resolution fails, any unresolved dispute will be brought exclusively in the state or federal courts located in Wayne County, Michigan, and you consent to the personal jurisdiction and venue of those courts.
Class actions are not permitted. You agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative action.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or confidential information.
If you live in the European Union, the United Kingdom, or another country whose consumer laws give you rights these Terms cannot remove, those rights still apply to you. You may bring a claim in the courts where you live, and nothing in this section takes away protection given by the law of your country.
Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will notify you within the App and update the "Effective date" above. Where required by law, we will obtain your renewed acceptance before the changes take effect.
If we make a material change, we will tell you in the App before it applies to you and ask you to agree. Until you agree, the earlier Terms you accepted keep applying to you. If you do not agree, you can delete your account, and we will refund any prepaid Premium time where the store lets us.
Miscellaneous
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Hayaa LLC regarding the App and supersede any prior agreements on the same subject.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
